Supreme Court voids native law that denies females from inheritance
Supreme Court voids native law that denies females from inheritance.
Females are now to partake in inheritance according to latest supreme judgment last.
In its judgment on the appeal filed in 2004 by Mrs. Lois Chituru Ukeje (wife of the late Lazarus Ogbonna Ukeje) and their son, Enyinnaya Lazarus Ukeje, against Mrs. Cladys Ada Ukeje (the deceased’s daughter), the apex court held that the practice conflicts with Section 42(1)(a) and (2) of the Nigerian Constitution.
In her ruling, Justice Bode Rhodes-Vivour, held that “no matter the circumstances of the birth of a female child, such a child is entitled to an inheritance from her later father’s estate. Although it is a welcome development what happens to other native laws that clash with the Nigerian constitution.
